SMARTERBROADBAND LLC’S PRIVACY POLICY (Internet Service) 
Effective as of April 1, 2025 

 
PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING SMARTERBROADBAND LLC ("SBB") SERVICES. 

 
1. COMMITMENT TO PRIVACY: SBB is committed to respecting the privacy rights of 
customers, and other users of its services. SBB believes that when customers use any of SBB’s services, they should understand when and how personal information is collected, used, disclosed, and protected. SBB created this Privacy Policy (the “Policy”) to give customers information and confidence as they visit and use SBB’s Services, and to demonstrate SBB’s commitment to fair information practices and privacy protection. By using the SBB services, customers are consenting to the collection and use of personal information as described in this Policy. 

 
2. WHAT INFORMATION DOES SBB COLLECT ABOUT YOU? SBB collects 
information about users of its services in the normal course of its business, and through its Sites. When you visit or browse a SBB Site, you may provide SBB with personal information that can be directly associated with a specific person or entity, website use information regarding a group or category of services or customers. SBB may also collect information from other sources and combine it with your account information. 
2A. Personal Information. SBB collects information you provide when you purchase, contract for, or use SBB services. This information is used for billing purposes so you can be appropriately charged (and, in some cases, to investigate fraudulent usages). For example, we may collect: 
· Name 
· Mailing address 
· E-mail address, content of e-mail messages, and responses 
· Credit card number 
· Telephone numbers 
2BWebsite Information. SBB’s web servers automatically receive certain types 
of information when you use a SBB Site, for example, your domain name and 
IP address(es), date and time of visits, the type of browser you use, the website 
from which your visit originated, page visits, time spent on individual web pages, 
and other similar website “traffic data." No other personal information about you is 
revealed in this process. SBB may sometimes use the "cookies" feature of 
major browser applications that allow it to store a small piece of data on your 
computer about your visit to SBB’s Sites. SBB does not set any personally identifiable information in cookies. SBB only uses cookies to collect website use information so that it can determine how to improve its services, complete transactions you request, and track your selections to make appropriate recommendations about SBB’s service. You can generally choose whether to accept cookies by changing the settings on your website browser. However, if you choose to disable this function, your experience at a Site may be diminished and some features may not work as they were intended. 
2C. Information from Other Sources. SBB may obtain information about you from 
outside sources and add it to or combine it with your account information. SBB may also use marketing information from third parties to help better serve you or inform you about other products or services. SBB sometimes receives updated delivery and address information from its shippers or other sources. SBB also receives information from agents from whom you purchase SBB services. 

 
3. HOW DOES SBB USE THE PERSONAL AND WEBSITE INFORMATION THAT IT 
COLLECTS? SBB uses your personal and website use information in order to 
provide optimal customer service, engage in its business activities, and inform you 
about other services.                                                                                                                                                 3A. Use of Personal Information. SBB does not share your personal information 
with any third parties without your consent, except as necessary to provide you with 
services or to comply with laws. SBB may use your personal information to verify your identity or follow up with transactions initiated on SBB Sites. SBB may also use your 
contact information to send you additional information about SBB. If at any time you do not wish to receive these communications, please let SBB know (see contact information below). When SBB uses other agents, contractors, or companies to perform services on its behalf, SBB advises them that they are to protect your confidential information and not disclose such information except in limited circumstances.                                                                       3B. Use of Website Information. SBB may use anonymous IP addresses to help 
diagnose problems with its servers, or administer its Sites.                                                                       3C. Use of Information to Protect SBB and Others. SBB will disclose 
personal information only if required to do so by law, (1) conform or adhere to legal requirements, (2) protect and defend the rights or property of SBB or the users of its service, or (3) act in case of emergency to protect the safety of the public or users of its service. 

 
4. CALIFORNIA CONSUMER PRIVACY ACT (CCPA). If you are a California resident, you 
have certain rights pursuant to the California Consumer Privacy Act. These CCPA rights 
may only apply in certain circumstances and are subject to certain exemptions. The 
following provides a summary of your rights. You can exercise these rights by 
contacting SBB using the contact information identified below. 
4A. Right to Know. You may request that SBB disclose to you: (1) the categories 
and/or specific pieces of personal information SBB has collected about you, 
(2) the categories of sources for that personal information, (3) the purposes for 
which SBB uses that information, (4) the categories of third parties with 
whom SBB discloses the information, and (5) the categories of information 
that SBB discloses to third parties. 
4B. Right to Delete. You can request that SBB delete personal information that 
SBB collected from you and tell its service providers to do the same, subject 
to certain exceptions (such as if SBB is legally required to keep the 
information). 
4C. Right to Opt-Out of Sale or Sharing. You may request that SBB stop selling or 
sharing your personal information (“opt-out”). In that event, SBB cannot sell 
or share your personal information after it receives your opt-out request unless you 
later authorize SBB to do so again. SBB does not sell or share your 
personal information with third parties, except as necessary to provide you with 
services or to comply with laws, therefore there is no need to exercise 
the right to “opt-out”. 
4D. Right to Correct. You may ask SBB to correct inaccurate information that it 
has about you. 
4E. Right to Limit Use and Disclosure of Sensitive Personal Information. You can direct 
SBB to only use your sensitive personal information (for example, your social 
security number, financial account information, your precise geolocation data, or 
your genetic data) for limited purposes, such as providing you with the services you 
requested. 
4F. Right to Non-Discrimination. SBB cannot deny goods or services, charge you 
a different price, or provide a different level or quality of goods or services just 
because you exercised your rights under the CCPA. 

 
5. CHILDREN'S ONLINE PRIVACY PROTECTION ACT. SBB’s Sites are general 
audience websites, and SBB does not direct any content specifically at children 
under 13 years of age. SBB understands and is committed to respecting the 
sensitive nature of children’s privacy online. SBB also recognizes that many 
parents purchase products and services for family use, including use by children under 
13, without SBB’s knowledge. Any information collected from such accounts 
would appear to SBB as the personal information of the subscribing adult 
customer and will be treated as such under this Policy. If SBB makes available 
offers and products online where a child informs us that he or she is under the age of 
13, or SBB otherwise learns or has reason to suspect that a Site's user is under 
13, SBB will ask a parent to confirm his/her consent in advance of further 
collection, use, or disclosure of personal information from that child. At any time, 
parents may review the personal information collected, ask to have it deleted, and 
refuse to allow any further collection or use of the child's information. 

 
6. PLACEMENT OF ADVERTISING ON OTHER WEBSITES. SBB may place 
advertisements for its products or services on other websites or use third-party ad 
companies to place advertisements about its services on other websites. 
These companies may use cookies and other technology to measure the effectiveness 
of SBB’s advertisements. To measure advertising effectiveness and offer selective 
ad content, the ad serving companies may use anonymous information about your 
visits to SBB’s and other websites. However, the ad serving companies use an 
anonymous number to identify you -- not your name, address, phone number, email 
address, or anything that personally identifies you. The use of such cookies is subject to 
the ad serving company's privacy policy, not this Policy. 

 
7. NETWORK AND INFORMATION SECURITY. SBB maintains a variety of physical, 
electronic, and procedural safeguards to prevent the loss, misuse, and alteration of the 
information that SBB obtains from you, but SBB cannot guarantee its ability 
to prevent loss, misuse, or alteration of such information.  

 
8. UPDATING THIS POLICY. SBB may revise, amend, or modify this Policy from time 
to time. Notice of any revision, amendment, or modification will be posted on 
SBB 's website, and/or on your start pages and/or by email and/or in mailings to 
your primary SBB email account and will be effective on the date noted in the 
posting. This Policy may not be amended or modified by you except by means of a 
written document signed by both you and an authorized representative of SBB. By 
continuing to use SBB 's services after the amendments are 
effective, you accept and agree to abide by them. 


9. THIRD PARTY WEBSITE AREAS BEYOND SBB 'S CONTROL. The Sites may contain 
links to other websites. If you choose to visit other websites, SBB’s Policy is no 
longer in effect. SBB is not responsible for the privacy practices or content of 
other websites, and it is your responsibility to review the privacy policies of other 
websites to ensure that you agree to their policies.
